1. Introduction & Acceptance of Terms

Welcome to AMOLIH (“we,” “us,” “our”), a fine jewellery brand operated by AMOLEE JEWELS PRIVATE LIMITED, a company incorporated under the laws of India, with its registered office at S-10 Jeevan Vihar, New Colony, 302001, Jaipur, Rajasthan.

These Terms and Conditions (“Terms”) govern your access to and use of our website located at [www.amolih.com] (the “Site”), including all purchases of products made through the Site within the territory of India. By accessing or using the Site, placing an order, or creating an account, you agree to be bound by these Terms, our Privacy Policy, and our Shipping and Returns Policies, all of which are incorporated herein by reference.

If you do not agree to these Terms, please do not access or use the Site. We reserve the right to modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the Site, and your continued use of the Site after such posting constitutes your acceptance of the modified Terms.

You must be at least 18 years of age to use this Site or place an order. By using the Site, you represent and warrant that you are of legal age to form a binding contract under the Indian Contract Act, 1872.

2. Definitions

In these Terms, the following words and expressions shall have the meanings assigned to them below, unless the context otherwise requires:

“Customer” or “You” means any person who accesses or uses the Site, registers an account, or places an order for Products.

“Products” means all jewellery items, including but not limited to gold, silver, gemstone, and custom-made jewellery, gift cards, and any related accessories or add-ons listed for sale on the Site.

“Order” means a request placed by You through the Site to purchase one or more Products, subject to confirmation by AMOLIH.

“Custom Order” means any Product that is personalised, engraved, made-to-order, or designed specifically to Your specifications through our WhatsApp consultation or custom design service.

“BIS” means the Bureau of Indian Standards, the national standards body of India responsible for hallmarking gold and silver jewellery.

3. Account Registration

To place an Order, you may be required to create an account on the Site. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account or any other breach of security.

AMOLIH reserves the right to suspend or terminate your account at its sole discretion if any information provided by you is found to be false, inaccurate, incomplete, or in violation of these Terms.

4. Products, Pricing & Payment

4.1 Product Information

We make every effort to display our Products as accurately as possible on the Site. However, due to variations in device screens and monitor settings, the actual colour, texture, and appearance of a Product may differ slightly from its representation on the Site. Such variations shall not constitute a defect in the Product.

All gold jewellery sold by AMOLIH is BIS hallmarked in accordance with the Bureau of Indian Standards Act, 2016, and the Hallmarking of Gold Jewellery and Gold Artefacts Order. Each Product is accompanied by a certificate of authenticity detailing its purity, weight, and specifications.

4.2 Pricing

All prices displayed on the Site are quoted in Indian Rupees (₹) and are inclusive of all applicable Goods and Services Tax (GST) as per the prevailing rates. Prices of precious metal and gemstone products are dynamic and are subject to change without prior notice due to fluctuations in the market price of gold, silver, diamonds, and other precious materials.

In the event of a pricing error due to typographical, technical, or system errors, AMOLIH reserves the right to cancel or modify the Order before or after confirmation and to notify the Customer of the correct price. If the Customer does not wish to proceed at the corrected price, a full refund of any amount already paid will be processed.

As per the guidelines mandated by the Government of India, Customers are required to provide their Permanent Account Number (PAN) for all purchases exceeding ₹2,00,000 (Indian Rupees Two Lakhs) in a single transaction.

4.3 Payment Methods

We accept the following payment methods for domestic orders:

Credit Cards (Visa, Mastercard, American Express, RuPay)
Debit Cards (Visa, Mastercard, RuPay)
Net Banking (all major Indian banks)
Unified Payments Interface (UPI) — Google Pay, PhonePe, Paytm, BHIM
Wallets (Paytm, Mobikwik, and other supported wallets)

All payments are processed through secure, PCI-DSS compliant payment gateways. AMOLIH does not store your credit card, debit card, or banking information on its servers.

5. Order Placement & Confirmation

Placing an Order on the Site constitutes an offer by You to purchase the selected Products. All Orders are subject to acceptance and confirmation by AMOLIH. We reserve the right to accept or decline any Order, in whole or in part, for any reason, including but not limited to product availability, pricing errors, suspected fraud, or failure of identity verification.

Upon successful placement of an Order, you will receive an Order Confirmation via email and/or SMS to the contact details registered with your account. This confirmation acknowledges receipt of your Order but does not constitute acceptance. Acceptance of your Order occurs when the Product is dispatched, and a Dispatch Confirmation is sent to you.

You may request cancellation of an Order at any time before the Dispatch Confirmation is sent. Once the Product has been dispatched, cancellation is no longer possible, and the product must be returned in accordance with our Returns Policy.

For Custom Orders, cancellation is not permitted and no refund will be issued.

6. Shipping & Delivery

6.1 Shipping Coverage

AMOLIH ships to all serviceable pin codes across India. Delivery availability to your specific location is determined at the time of checkout based on your pin code.

6.2 Shipping Charges & Timelines

Shipping charges and estimated delivery timelines will be displayed at checkout. All international shipments are fully insured and shipped via COURIER PARTNERS, e.g., FedEx, DHL, UPS with end-to-end tracking. A signature may be required upon delivery for high-value orders. All Products are shipped from our workshop in Jaipur, India.

AMOLIH is not liable for delays caused by customs clearance, courier partners, natural disasters, public holidays, or other circumstances beyond our reasonable control.

7. Returns, Exchanges & Refunds

7.1 Return Window

AMOLIH offers a 15-day return and exchange policy from the date of delivery for all eligible Products purchased on the Site. To be eligible for a return, the Product must be in its original, unworn condition, with all original tags, certificates, packaging, and documentation intact.

7.2 How to Initiate a Return

Upon approval of your return request, we will arrange a fully insured, free reverse pickup from your location. Please ensure the Product is securely packed in its original packaging for the return shipment.

7.3 Non-Returnable Items

The following Products are not eligible for returns or exchanges:

Custom-made, personalised, or engraved jewellery
Products that have been worn, altered, resized, or damaged after delivery
Gift cards and digital vouchers
Products returned without original certificates, tags, and packaging
Products that show signs of tampering or are not in the condition in which they were delivered

7.4 Exchanges

If you wish to exchange a Product for a different design or size, you may do so within the return window, subject to availability. If the replacement Product is of a higher value, you will be required to pay the difference. If the replacement is of a lower value, the difference will be refunded to your original payment method.

7.5 Refund Processing

Upon receipt and inspection of the returned Product, your refund will be processed within 14 business days to the original payment method. Original shipping fees are non-refundable unless the return is due to a defect, damage, or error on AMOLIH’s part.

8. Custom Orders & Design Collaboration

AMOLIH specialises in bespoke, made-to-order jewellery. Our custom design process begins with a consultation via WhatsApp, where you share your ideas, preferences, and budget with our design team. Based on your inputs, we create a design proposal for your review and approval.

By approving a custom design and making payment, you acknowledge and agree that:

Custom Orders are crafted specifically to your specifications and are therefore non-returnable, non-exchangeable, and non-refundable once production has commenced
Minor variations in handcrafted items (including slight differences in weight, dimensions, texture, and gemstone appearance) are inherent to the artisanal process and do not constitute defects
Delivery timelines for Custom Orders are estimates and may vary depending on the complexity of the design and material availability
AMOLIH retains the right to use photographs and descriptions of custom-created designs for marketing and portfolio purposes, unless you request otherwise in writing

9. Intellectual Property

All content on the Site — including but not limited to text, photographs, graphics, logos, icons, product designs, the AMOLIH name and wordmark, the AMOLIH monkey symbol, and all associated branding elements — is the exclusive property of AMOLIH or its licensors and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws of India.

You may not reproduce, distribute, display, transmit, modify, create derivative works from, or commercially exploit any content from the Site without prior written consent from AMOLIH.

10. Privacy & Data Protection

Your privacy is important to us. Our collection, use, storage, and processing of your personal information is governed by our Privacy Policy, available at https://www.amolih.com/pages/privacy-policy. By using the Site, you consent to the collection and use of your data as described in our Privacy Policy.

We comply with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023, as applicable, in relation to the handling of your personal data.

11. Limitation of Liability

To the fullest extent permitted by applicable law, AMOLIH, its directors, officers, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunity, arising out of or in connection with your use of the Site, the purchase of Products, or any other matter related to these Terms.

In no event shall AMOLIH’s total aggregate liability to You for all claims arising out of or in connection with these Terms exceed the total amount paid by You for the specific Product giving rise to the claim.

Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable Indian law.

12. Indemnification

You agree to indemnify, defend, and hold harmless AMOLIH, its directors, officers, employees, affiliates, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your use of the Site, or any violation of any law or the rights of any third party.

13. Force Majeure

AMOLIH shall not be liable for any failure or delay in performance of its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to natural disasters, epidemics, pandemics, acts of government, war, civil unrest, strikes, lockouts, supply chain disruptions, transportation failures, or failures of telecommunications or power infrastructure.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Jaipur, India, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall first be attempted to be resolved amicably through direct negotiation between the parties. If the dispute is not resolved within 30 days of written notice, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The seat of arbitration shall be Jaipur . The arbitration proceedings shall be conducted in English.

Subject to the foregoing, the courts at Jaipur, India, shall have exclusive jurisdiction over any matters arising under these Terms.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Returns Policy, constitute the entire agreement between You and AMOLIH with respect to the subject matter herein and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

15.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall continue in full force and effect.

15.3 Waiver

No failure or delay by AMOLIH in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any such right, power, or remedy preclude any other or further exercise thereof.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without the prior written consent of AMOLIH. AMOLIH may assign its rights and obligations under these Terms to any affiliate or successor entity without prior notice.

15.5 Notices

All notices and communications from AMOLIH to You will be sent to the email address or phone number registered with your account. It is your responsibility to ensure your contact details are current and accurate.
